Terms and Conditions

§ 1 Scope
These General Terms and Conditions (hereinafter "T&C") apply to all contracts between Leifhelm Medien (hereinafter "Provider") and the user (hereinafter "Customer") regarding the use of the FITview software.
§ 2 Subject of the contract
The Provider offers cloud-based software for the digital display of class schedules, optionally extended with premium modules (Story templates, contest). The specific scope of services depends on the package selected by the Customer.
§ 3 Conclusion of contract and trial phase
- The Customer registers on the Provider's website for a 30-day free trial.
- During registration, the Customer deposits payment details (SEPA direct debit mandate or credit card).
- After 30 days, the trial automatically converts into a paid annual subscription unless the Customer cancels before the end of the trial period.
- The amount of the annual fee is based on the package configuration chosen by the Customer at the time of registration.
§ 4 Prices and payment terms
- All prices are exclusive of statutory VAT.
- Billing occurs annually in advance.
- Payment is made via SEPA direct debit or credit card through the payment service provider Mollie.
- In the event of payment default, the Provider is entitled to restrict access to the software.
§ 5 Contract term and cancellation
- The subscription has a minimum term of 12 months from the end of the trial period.
- The Customer may cancel at any time effective at the end of the current annual period.
- If no cancellation is made, the subscription automatically renews for another 12 months.
- Cancellation can be made in text form or via the self-service function in the software.
§ 6 Customer obligations
- The Customer is responsible for entering the required data (studio details, class schedules, image material) themselves.
- The Customer ensures that they have the necessary rights to uploaded content.
- The Customer is liable for all actions taken under their account.
§ 7 Availability
The Provider aims for software availability of 99 % on annual average. Planned maintenance will be announced in advance.
§ 8 Liability
The Provider is liable without limitation for intent and gross negligence. Otherwise, the Provider is only liable to the extent legally required.
§ 9 Data protection
The Provider's separate privacy policy applies, available at /datenschutz.
§ 10 Final provisions
- The law of the Federal Republic of Germany applies.
- Place of jurisdiction is, as far as legally permissible, the registered office of the Provider.
- Should individual provisions of these T&C be invalid, the validity of the remaining provisions shall remain unaffected.
